These Terms of Use (the “Terms”) govern your use of the website at nyautorepairshops.com (the “Site”), operated by NY Auto Repair Shops (“we”, “us”). By using the Site you agree to them. If you do not agree, please do not use the Site.
1. The Site
The Site is a free directory of auto repair shops and inspection stations in New York State, compiled from public records. There are no accounts and nothing to sign up for. We may change, suspend or discontinue any part of the Site at any time.
2. No professional or endorsement relationship
The Site is an independent directory. We are not affiliated with the New York State Department of Motor Vehicles, with Google, or with any shop listed. A listing is not an endorsement, a recommendation, a certification, or a statement that a shop is competent, honest or currently licensed. Nothing on the Site is legal, mechanical or safety advice. Verify anything that matters directly with the DMV and with the shop.
3. Accuracy of the data
Licence, inspection and review information is only as accurate as the public records and public listings it is copied from, and it is refreshed periodically rather than continuously. Records may be stale, incomplete, mis-keyed at source, or matched to the wrong business. Each shop page links to the underlying DMV record so you can check it yourself. If you are a shop owner and something is wrong, email claim@nyautorepairshops.com with the shop name and DMV facility number and we will look at it.
4. Acceptable use
You agree not to use the Site to break the law or infringe anyone’s rights; to scrape, harvest or bulk-copy it by automated means beyond ordinary search-engine crawling; to overload, probe or interfere with it or the networks it runs on; to gain unauthorised access to any part of it; to misrepresent yourself as a shop you do not own; or to use anything from the Site to harass a business or an individual. Where the source data is a public record, go to the public record rather than mass-copying our pages.
5. Content and intellectual property
The underlying facts are public records and are not ours. Our selection, arrangement, wording and design of the Site are, and are protected by intellectual property law. Review text, ratings and photographs come from public Google Maps listings and remain the property of their authors and of Google; we display them as attributed excerpts and claim no ownership.
If you believe something on the Site infringes your copyright, email hello@nyautorepairshops.com identifying the work, the page, and your contact details, and we will review it promptly.
6. Third-party links and services
The Site links to third-party sites, including shop websites, Google Maps and data.ny.gov. We do not control them and are not responsible for their content, accuracy, availability or privacy practices. Your dealings with any shop are solely between you and that shop.
7. Paid listings
Where a shop owner pays to claim a page, the fee covers the ability to add and correct details on that page. It never changes the DMV figures, the ordering of results, or the review content, and it buys no endorsement. Claimed pages are identified as such.
8. Disclaimers
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE CONTENT IS ACCURATE, CURRENT OR COMPLETE. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR LOST DATA, ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF (OR INABILITY TO USE) THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS IS CAPPED AT THE GREATER OF (i) USD $50 AND (ii) THE AMOUNT YOU PAID US IN THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THESE EXCLUSIONS, SO THEY MAY NOT APPLY TO YOU.
10. Indemnification
You agree to defend, indemnify and hold us harmless from claims and reasonable costs and attorneys’ fees arising out of your use of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.
11. Termination
We may suspend or block access to the Site at any time, including if we believe these Terms have been violated. Sections 2 through 12 survive any termination.
12. Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. The state and federal courts located in New York State have exclusive jurisdiction over any dispute arising out of them, and you consent to that jurisdiction and venue. Nothing here removes a right you have under a consumer protection law of the place you live that cannot be waived.
13. Changes and contact
We may update these Terms; the date below shows when they last changed, and continuing to use the Site after a change means you accept it. Questions go to hello@nyautorepairshops.com. Your use of the Site is also governed by our Privacy Policy and Cookie Notice, which are incorporated into these Terms by reference.
